Breeding Miscue Robbed Taste from Supermarket Tomatoes

Supermarket tomatoes were bred to all turn light green at the same time, but what came along for that ride was a reduction in the ability to produce sugar. Cynthia Graber reports

For many people summer equals tomatoes. That?s when folks can get their hands on gorgeous heirloom and traditional varieties, full of tomatoey flavor. Such tomatoes provide a stark contrast to year-round supermarket ones, famous for tasting like, well, nothing. They?ve been bred for uniform color and ripening?not for taste.

Now scientists have determined just what?s genetically missing in store-bought tomatoes.

The researchers honed in on two transcription factors. Transcription factors are proteins that control the expression of genes?in this case they?re necessary for the production of chloroplasts, which allow sunlight to generate sugars and other compounds.

Darker green tomato fruit expresses genes that make possible increased photosynthesis?and so the fruits are able to produce more sugars for a tastier end product. But typical supermarket tomatoes, which had been bred to all turn light green at the same time, were also accidentally bred with reduced chloroplasts?and thus reduced sugar content. The research was published in the journal Science. [Ann L.T. Powell et al., "Uniform ripening Encodes a Golden 2-like Transcription Factor Regulating Tomato Fruit Chloroplast Development"]

The scientists say understanding the genes involved in better flavor could enable growers to offer tastier supermarket varieties. So that when you say tomato, I can say to-ma-to or to-mah-to instead of bleech.

High court delivers blow to Florida Republican leaders

The U.S. Supreme Court upheld key provisions of the 2010 federal health care overhaul Thursday, dealing a major defeat to Gov. Rick Scott and Florida Republican leaders, who have been clamoring for justices to kill the law.

Chief Financial Officer Jeff Atwater initially issued a statement praising the high court for striking down the law?s central provision ? that citizens must obtain health insurance. But Atwater quickly recalled his email when it became clear the court upheld the mandate.

Scott is expected to respond to the ruling close to noon.? Attorney General Pam Bondi, who also spearheaded Florida?s role in challenging the 2010 federal? law and attended March arguments in the case, also plans to speak then.

Scott, Bondi and other members of the Florida Cabinet were meeting as the state?s Clemency Board when the ruling came down Thursday.

Florida Republican leaders, however, are likely to hail the court?s decision that states cannot lose all Medicaid funding if they fail to embrace the law?s sweeping expansion of the program serving the poor, elderly and disabled.

Scott and leaders in the Republican-dominated Florida Legislature have clamored for Congress to grant the state?s Medicaid block grants, a call that is expected to be revived with Thursday?s ruling. Scott has already urged Congress to repeal the 2010 law, a push that is certain to play a pivotal role in this fall?s presidential race.

Block grants would allow states to design their own health programs for low-income, elderly and disabled residents, that? fit within their own budgets.

Critics, however, see block grants as merely a tactic by states seeking to cut benefits.

Excuses, Fearmongering and Sour Grapes Are Only Certainty In GOP's Response To Health Care Reform

As a supporter of Medicare For All or a genuine public option at the minimum, I'm still only lukewarm to Obama's health care reform act despite the law being affirmed by the highest court in the land. I also suspect more fall-out from the court?s mixed decision, most notably in its weakening of the law?s Medicaid provisions in the name of states? rights.

But if I were the republican governor of a state, I'd certainly proceed with the framework of state-run health care exchanges, knowing that the exchanges are a requirement in practically every proposal for health care reform proposal written over the past 30 years.

Gov. Scott Walker however says Wisconsin will not proceed with implementing the Affordable Care Act because the SCOTUS decision he claims, creates uncertainty.

Channel 3000 Excerpt:
In the meantime, Walker says the state will not proceed with setting up a health care exchange as is required.[...]

He said the decision creates uncertainty for Wisconsin businesses and that's bad for job growth. Walker has also said businesses will be bullish about adding jobs since he won a June 5 recall election.

Bad for job growth but businesses remain bullish about adding jobs? Which is it?

But tell that to four (Minnesota, Michigan, Illinois and even Tea Party Mitch Daniels Indiana) of the six midwestern states that have all outjobbed Wisconsin in 2011 while instituting that "uncertainty" by building the framework for the state health care exchanges in the new health care law. Add to that the fact that two (California and New York) of the top three states in the country that have had significant increases in employment from May, 2011 to May, 2012 have implemented the ACA almost in it's entirety. While three states with dismal job growth, North Carolina, Alaska and New Mexico have literally banned the ACA. Beginning this week, New Mexico has finally initiated a task force to develop a proposal for creating a state health insurance exchange. So how can the decision be bad for job growth?

Even more ridiculous is to say the decision is bad for Wisconsin. But we'll have to go in circles here for just a moment to tackle that one.

Walker's belligerent failure to implement the law has the same impact on the state as if SCOTUS struck it down. So the decision can't be bad for job growth or create "uncertainty" for Wisconsin businesses if he refuses to implement it. Without implementing the Affordable Care Act, it's business as usual for the GOP and the state of Wisconsin. With the recalls behind us, the state should be gushing in certainty ...and jobs according to Scott Walker.

Conversely, he could have claimed Obama's health care reform was bad for job growth given the poor state employment results of the past year, but only if he had implemented it. He missed that opportunity by fighting it every step of the way. But this is where the rubber meets the road. The GOP's (and Walker's) biggest fear is not that Obama's health care reform fails - but if it would succeed. The idea of course is to never give it a chance.

So using Walker's fearmongering and certainty logic, only states that implemented the federal health care law have "uncertainty," yet those same states have experienced some of the most significant job growth over the past year AND if Walker was right, that should have translated into businesses and workers fleeing those states for Wisconsin.

But we know that's not happening and Walker is playing politics as usual and fabricating more uncertainty by hedging on not implementing the health care plan, with the intention to blame the health care law for all that fails in the state by not implementing it. That's full circle insanity.

Mitt Romney also found himself in a similar foot-in-mouth position earlier this week by saying if the nation?s highest court overturned what he derides as Obamacare, ?then the first 3 1/2 years of this president?s term will have been wasted on something that has not helped the American people.?

Boston.Com Excerpt:
Yet the court, with the vote of conservative Chief Justice John Roberts, today upheld the law?s constitutionality.

Accepting Romney?s logic, that would mean that the bulk of Obama?s first term in office was spent on something that helped the American people.

Roberts is not someone Romney can dismiss, either. On his campaign website, he pledges to nominate Supreme Court justices ?in the mold of Chief Justice Roberts,? as well as other court conservatives.

Epic backfire.

Wray Herbert: Is Feeling Bad a Luxury Problem?

In Judith Viorst's classic children's book Alexander and the Terrible, Horrible, No Good, Very Bad Day, Alexander wakes up with chewing gum in his hair -- and everything goes downhill from there. He trips on his skateboard and drops his sweater in the sink. He doesn't get a window seat in the car, and the dentist tells him he has a cavity. His mother makes him get white sneakers instead of the blue-and-red-striped ones he covets. He's forced to eat lima beans for dinner, and there's kissing on TV. To top it all, his nightlight burns out just as he's getting ready for bed.

Alexander's plight resonates not just with kids but with any adult who has ever whined about a luxury problem. Alexander is clearly a very fortunate child. He has food on the dinner table every day, a warm bed for sleep, dental care, a sweater, and sneakers, not to mention real luxuries like a TV and a skateboard. So when we read about the spoiled child's tantrums, we can't help but be reminded that most of the stresses in our adult lives -- the congested commuter traffic, the workplace conflict, the leaky roof -- are also luxury problems.

Health experts call these "first-world problems," meaning the accumulated stresses of daily life and the negative emotions they arouse. There's little doubt that worry and anger and sadness are linked to illness and mortality, right down to the cellular level, but isn't this just the downside of privilege? Those of us who live in modern, industrialized nations may indeed be sickened by negative emotions, but surely this phenomenon is eclipsed by more pressing and serious health risks in the developing world, by "real" problems like famine, poverty, and war.

Or is it? The fact is, we don't know. The question never been studied. That's why University of Kansas psychological scientist Sarah Pressman and her colleagues decided to examine the emotion-health link in 142 countries across the planet, including many with persistent, daily risks to health and well-being, like prolonged civil war and drought. The scientists surveyed more than 150,000 people, ranging in age from 15 to 99, a representative sample of the world population participating in the Gallup World Poll. They queried these people about the specific negative emotions they had experienced the previous day -- worry, sadness, boredom, depression, and so forth -- and about positive emotions, including happiness, laughter, and love.

In addition to these data on everyday feelings, the scientists took various measures of health: Do you have any health problems that prevent regular activity? How well rested do you feel? Are you experiencing pain? They asked, in general, how satisfied or dissatisfied these people were with their health. They also asked about their basic needs -- for money, shelter, food, and water -- and about crime, safety, and sense of security.

Emotions matter to health -- everywhere. That's the main finding from this first-ever worldwide analysis. As reported in a forthcoming issue of the journal Psychological Science, both positive and negative emotions were uniquely linked to health, and unexpectedly, emotions were actually better predictors of health and illness than were basic unmet needs, for food, safety, and shelter. What's more, emotions are not a first-world problem; indeed, the opposite appears to be true. The poorer the country (as indicated by GDP), the stronger the connection between emotions and health. Positive emotions (or their scarcity) appear especially important to individual health status in poorer countries.

Alexander's solution for all his cares and woes is to move to Australia. In the Australian version of this popular book, the solution is to move to Timbuktu. But as this study documents, there's no place on Earth to outrun the cascade of human emotions -- or the important health consequences of those everyday feelings.

California State Athletic Commission facing major financial difficulties

Things are not going well for the California State Athletic Commission. They are having severe financial troubles, and recently censured George Dodd, their executive director, for not telling the board just how bad the money situation is.

MMA Fighting is reporting the group that oversees MMA events is already under water, and could run a deficit of $700,000 by the time the year is over.

"Without the ability to pay for even basic services, the Commission will have no choice but to cease operation immediately and cancel or postpone indefinitely all Commission regulated events," Department of Consumer Affairs (DCA) director Denise Brown wrote in a recent letter to CSAC's executive director George Dodd.

Zuffa has three events scheduled for California in the next two months. UFC on Fuel 4 will be in San Jose, UFC on Fox 4 will take place in Los Angeles and Strikeforce's championship bout between Ronda Rousey and Sarah Kaufman is set for San Diego. None of these events are expected to be affected, but California is a go-to state for Zuffa. California hosted four UFC and Strikeforce events in 2011.

Considering the state's financial problems, it's not a surprise to see the CSAC stumble. California is projecting a deficit of $4 billion, and has been running in the red for four years. There financial problems are so well-known there is a Wikipedia entry devoted to California's budget crisis.

But where the true problem lies for the CSAC is how to dig out of their hole. Without money, they can't run high-grossing events, but without high-grossing events, they can't earn money.

COLORADO SPRINGS, Colo. (AP) ? After waiting for two days, Rebekah and Byron Largent learned from lists distributed by authorities that their home was among the hundreds that burned to the ground in the most destructive wildfire ever to rage across Colorado.

It was especially hurtful as their house was destroyed on their daughter Emma's first birthday.

"Our minds just started sifting through all the memories of that house that we lost that can't be replaced," Rebekah Largent said Thursday night. She remembered her wedding dress, a grandmother's china, the rocking chair where the couple would sit with Emma.

"Our little girl, our 1-year-old daughter, that's the house that she's lived in the longest. It's just really hard to have lost a lot of the memories connected to that, you know? They just burned," she said.

Officials said the Waldo Canyon fire that forced tens of thousands to flee this city 60 miles south of Denver destroyed an estimated 346 homes and left at least one person dead.

Police Chief Pete Carey said the remains of one person were found in a home where two people had been reported missing. Neither the victim nor the missing person has been identified.

Carey said police are still trying to track down the whereabouts of "less than 10" people who may be unaccounted for.

President Barack Obama was to tour fire-stricken areas Friday after issuing a disaster declaration for Colorado, releasing federal funds to help.

Rich Harvey, the incident commander in charge of the massive firefighting effort, said the fire was held at bay overnight, with no growth of the perimeter and no more houses lost.

The fire was 15 percent contained Friday morning.

Jerri Marr, supervisor of the Pike and San Isabel national forests where the blaze started, said favorable weather was a boon to firefighters Thursday.

"Yesterday we had great weather," she said. "Looks like we're going to have that same weather today."

From above Colorado Springs, the destruction was painfully clear: Rows and rows of houses were reduced to smoldering ashes even as some homes just feet away survived largely intact.

When he first saw the aerial photos of the homes burned in his neighborhood, Ryan Schneider recognized immediately that his house had been spared.

But relief quickly turned to sadness for his many friends and neighbors who hadn't been so lucky.

"I mean, there's a lifetime of things that people collect in these homes, and they've lost it all," said Schneider, vice president of the 1,700-home community association for the Mountain Shadows neighborhood.

Amid the devastation in the foothills of Colorado Springs, there were hopeful signs. Weather conditions improved Thursday and some evacuation orders were lifted by the evening, though there was no immediate word on how many people would be allowed back. People were told to still be ready to flee at a moment's notice.

The Air Force Academy was letting residents return Friday morning and officials said normal operations would resume throughout most of the academy.

"We're gaining more confidence," said Bret Waters, director of the Colorado Springs emergency management office. "It doesn't mean we're out of the woods."

More than 30,000 people frantically packed up belongings Tuesday night as the flames swept through their neighborhoods.

The Colorado Bureau of Investigation said two people have been arrested in connection with a burglary at an evacuated home.

Community officials began the process of notifying residents Thursday that their homes were destroyed. The lists of more than 30 street names were posted at a local high school, listing those areas with heavy damage. Anxious residents scanned the sheets, but for many, the official notification was a formality. They recognized their street on aerial pictures and carefully scrutinize the images to determine the damage. Photos and video from The Associated Press and the Denver Post showed widespread damage.

Colorado Springs, the state's second-largest city, is home to the U.S. Olympic Training Center, NORAD and the Air Force Space Command, which operates military satellites. They were not threatened.

Conditions were still too dicey to allow authorities to begin trying to figure out what sparked the blaze that has raged for much of the week and already burned more than 26 square miles.

Authorities said earlier the fire was 29 square miles. More precise mapping often results in revisions of size estimates for active fires.

More than 1,000 personnel and six helicopters were fighting the fire, which had cost at least $3.2 million to fight.

All eight Air Force cargo planes equipped to fight wildfires will be operating Saturday out of Peterson Air Force Base in Colorado Springs, the Air Force said.

This will be the first time the entire fleet has been activated simultaneously since 2008, Col. Jerry Champlin said.

Four of the planes are already attacking Colorado wildfires from Peterson. Late Thursday, U.S. Northern Command approved a Forest Service request to activate the other four.

The C-130s are assigned to National Guard and Reserve units in California, Colorado, North Carolina and Wyoming.

Hundreds of people sought refuge at area shelters operated by the Red Cross, including tourists who'd come to enjoy the Colorado summer.

Preston Harrington, 40, of Lake Charles, La., had been hoping to climb nearby Pikes Peak.

He had been at a Manitou Springs motel when he was evacuated early Sunday, and then moved to a shelter at a high school and was living out of a suitcase

"No drawer, nothing to put this stuff in, it wears on you," Harrington said.

Schneider, the local neighborhood leader, said the enormity of the losses would take a while to sink in.

"There's a lot of tears being shed out there, it's tough," he said.

Among the fires elsewhere in the West:

? A 72-square-mile wildfire in central Utah has destroyed at least 56 structures and continues to burn with just 20 percent containment, authorities said. Officials expected the damage estimate to rise as they continue their assessment.

? The smaller fire near St. George, Utah, started Wednesday and had grown to 2,000 acres by midnight, forcing some residents to evacuate. The fire, which was 60 percent contained Friday, was burning about three miles north of Zion National Park. At least eight structures were destroyed.

? Fire crews in southeastern Montana used a break in the weather to dig containment lines around two wildfires that have burned 200 square miles and dozens of homes. The improved conditions led to residents clamoring to be let back in to check their properties and assess the damage, but authorities kept evacuation orders in place for hundreds of people.

? A Wyoming wildfire in the Bridger-Teton National Forest has grown from to nearly 36 square miles, officials said.

? In northern Colorado, about 1,900 people were allowed back into their homes on Thursday more than two weeks after the devastating High Park Fire erupted. The blaze was 85 percent contained. The fire killed one woman and destroyed 259 homes, authorities said Friday after the latest damage assessment. The destructive toll marked a state record until being eclipsed by the Colorado Springs fire.

? A wildfire gaining steam in western Colorado prompted officials to evacuate homes of about 50 residents in the southern part of De Beque as the 19-square-mile blaze threatened to cross Interstate 70 Thursday night. A 13-mile stretch of the highway was closed overnight but one lane in each direction reopened on Friday.

Reindeer is oldest UK rock art

A reindeer engraved on the wall of a cave in south Wales has been confirmed as the oldest known rock art in Britain.

The image in Cathole Cave on Gower, south Wales was created at least 14,000 years ago, said Bristol University.

Archaeologist Dr George Nash found the engraving while exploring a rear section of the cave in September 2010.

He said uranium dating showed it was the oldest rock art in the British Isles, if not north-western Europe.

The reindeer was engraved over a mineral deposit known as a speleothem, carved using a sharp-pointed tool, probably made of flint, by an artist using his or her right hand.

The animal's elongated torso has been infilled with irregular-spaced vertical and diagonal lines, whilst the legs and stylised antlers comprise simple lines.

Red Lady of Paviland

The minimum date is around 12,500 BC or 14,500 BP (years before present, which is terminology used by archaelogists), with a plus or minus of 560 years.

"The earlier date is comparable with uranium-series dating of flowstone that covers engraved figures within Church Hole Cave at Creswell along the Nottinghamshire/Derbyshire border," said Dr Nash, from Bristol University's Department of Archaeology and Anthropology.

"However, the new minimum date of 14,505 plus or minus 560 years BP makes the engraved reindeer in south Wales the oldest rock art in the British Isles, if not north-western Europe."

The limestone cliffs along the Gower coast are known for their archaeological importance.

The Red Lady of Paviland, actually the remains of a young man, is the earliest formal human burial to have been found in western Europe, around 29,000 years old.

It was discovered at Goat's Hole Cave at Paviland on Gower in 1823 by William Buckland, then a geology professor at Oxford University.

Earlier in June, a team from Bristol University confirmed that cave art discovered in El Castillo, Spain, was the oldest in Europe at more than 40,000 years old.

Man dies after being convicted in Ariz. arson case

(AP) ? A man collapsed in court and died after being convicted Thursday of deliberately burning down his $3.5 million Phoenix mansion.

Maricopa County sheriff's deputies said they were investigating whether Michael Marin put something in his mouth that led to his death after the verdict was read.

"We will have to wait until we get toxicology reports from the medical examiner until we can confirm if he did and what the substance was," sheriff's spokesman Jeff Sprong said in a written statement.

A jury had found Marin, 53, guilty of arson of an occupied structure. When his trial began in May, prosecutors said he faced up to nearly 16 years in prison if convicted.

Video from inside the courtroom showed Marin putting his hands over his eyes after the verdict was read and then covering his mouth with both hands.

As Judge Bruce Cohen and lawyers were discussing aggravating factors and the jury was out of the courtroom, Marin's face suddenly turned red and he began to make throat-clearing noises before he collapsed to the floor.

Marin's attorneys tried to assist him, and paramedics were called. Rescuers performed chest compressions but Marin was pronounced dead at a hospital.

Calls to his lawyer, Lindsay Abramson, and to the county medical examiner's office weren't immediately returned Thursday afternoon.

Prosecutors claimed Marin torched his Biltmore Estates mansion, near the Phoenix-Paradise Valley border, in July 2009 after it didn't sell at a charity auction. He had offered the 10,000-square-foot property to raise money for a Mesa-based child-welfare organization.

Prosecutors said Marin couldn't afford the monthly mortgage of $17,500 and had a balloon payment of $2.3 million coming due.

Authorities said Marin escaped the fire by climbing down a rope ladder while wearing a scuba tank and diving mask to protect him from the smoke.

Phoenix Fire Department investigators noted "four separate areas of origin" ? two upstairs and two downstairs ? and a Phoenix crime lab analysis revealed gasoline in two areas of the mansion.

Marin was a former attorney, banker and art collector who had nearly $900,000 in the bank in 2008 but only $50 at the time of the fire, the Arizona Republic reported.

Great Guide On How To Get A Good Auto Insurance Quote ...

When shopping around for car insurance, ask the company if they give a discount for insuring multiple cars with them. If your spouse has insured their car with a different company, or if you have multiple vehicles yourself, it typically makes sense to have all household cars insured by the same company if it will cost less.

If you?re involved in a car accident, it is usually a good idea to call the police and file a report, just to make sure you satisfy any requirements of your insurance company. Of course, there are certain situations that always require police involvement, such as when there are injuries or one of the drivers flees the scene. However, there are other times when you may need documentation by the police to substantiate your claim. This can happen if the driver who caused the accident refuses to provide you with his insurance information or if he admits that he doesn?t have any insurance. A police report also contains a very detailed description of the incident, which is helpful when your mind is occupied by other factors, such as the damage to your car and your concern about the safety of your passengers.

Do the math before filing an insurance claim to see if it is worth it. Insurance companies love to raise rates on drivers who file claims, it?s the nature of the industry. Avoid making claims that aren?t going to net you much money back. If you are filing a claim for two hundred dollars, is it really worth the extra premiums you?ll pay in the future?

If your goal is to lower the cost of your car insurance premium, remember that insurance companies often charge more to insure cars that are flashier or that cost more to repair. Having a low-profile vehicle, that is unlikely to get stolen, can often dramatically lower your rates.

Your teenage driver?s insurance will cost you much more than yours for a while, but if they took any formalized driving instruction, be sure to mention it when shopping for a quote or adding them to your policy. Discounts are frequently available for driving instruction, but you can get even bigger discounts if your teen took a defensive driving class or other specialized driving instruction course.

If you travel often and use rental cars during your travels, it might be beneficial to opt for including coverage for rental cars on your personal auto insurance. The amount charged by car rental agencies varies, but at times can be quite a significant increase in the amount you pay for your car rental.

An important consideration in securing affordable auto insurance is the condition of your credit record. It is quite common for insurers to review the credit reports of applicants in order to determine policy price and availability. Therefore, always make certain your credit report is accurate and as clean as possible before shopping for insurance.

Figure out what the minimum requirements are for your state. This is especially important if you have an older car and are planning on only purchasing the bare minimum coverage that is out there. This could keep you from breaking the law and save you a big hassle in the long run.

To lower your overall cost consider paying your insurance premium in full. Many insurance companies tack on fees for customers who make payments month to month. Your company may offer several payment option plans, but generally the less payments you make the more money you save. Some companies even offer an additional discount for enrolling in automatic renewal.

When obtaining a quote for auto insurance, have a list of your car?s safety features, this will qualify you to receive a discount. If your vehicle has full airbags or an installed security system, you may be eligible for a discount. At the same time, if you have a young driver with good grades in your home, you may qualify for discounts based on driver characteristics. Have this information handy so you can ask about all possible discounts.

If you are just buying a car for jetting around town, see if your insurance company offers discounts for low mileage driving. The less you drive, the less likely you are to have an accident that your insurance will have to pay for. Most companies recognize this with discount offers.

As you now may be starting to understand, the auto insurance purchasing process does not need to be as painful as it once was. The important thing to remember is to explore your options. By following the tips and advice from this article, you will help to ensure that you have the best experience, while getting the best deal possible.

Georgia Tech's Shimi robot wants to rock with you all night, rock the night away

Shimi certainly has the makings of a viral video hit, but its creators at Georgia Tech want you to know that there's more to the dancing robot than just a pretty face. The "interactive musical buddy," designed by the school's Center for Music Technology, is a one-foot-tall smartphone-enabled "docking station with a brain." Shimi has a whole slew of functionality, using the phone's face-detection to track listeners and better position its speakers. Users can also clap out a beat, which the 'bot will use to pull a matching song from the phone's playlist, playing the track and, naturally, dancing to the beat. Forthcoming functionality includes the ability for users to shake their heads or wave a hand to affect Shimi's song choices. Google I/O attendees will get the opportunity for a closer look at Shimi this week in San Francisco. In the meantime, check out a couple of videos of the robot doing its thing after the break.

Vandalism: A Game That Turns into a Legal Nightmare | NH Legal ...

NH criminal attorney

It may start out as innocent fun, tossing rocks at what looks to be a junk car, or spray painting an old wall. Maybe you didn?t have plans on doing anything all, but you got caught up in the wrong crowd who pressured to you do a little damage to another?s property.

New Hampshire law is clear; the destruction of property is considered a crime. If convicted, you could face serious penalties that result in a criminal misdemeanor or felony. A conviction lasts on your record forever. NH criminal law attorney Ryan Russman defends those who have been wrongly charged of vandalism.

What is Considered Vandalism?

In the summer of 2011, a group of minors trespassed onto school property in Concord, New Hampshire and slashed the tires of 27 school buses. The Concord Monitor reported that the school district had 29 buses. The destruction was discovered that morning, and the school had no way to transport approximately 2,500 students to school. The police arrested four students, and each minor was given one count of criminal mischief ? a felony charge.

Once charged and convicted of vandalism, you could face seven years in prison along with hefty fines of up to $4000.

Any type of destruction of another?s property is considered vandalism. An individual can be charged with a criminal misdemeanor or a felony based on the circumstances and past criminal records. Even if property seems unused or belonging to no one, if you destroy it, you could face penalties that change the course of your life. Acts of vandalism commonly include:

  • Breaking windows
  • Damaging benches or public seating areas
  • Ripping bus seats
  • Slashing tires
  • Moving or breaking tombstones
  • Scratching windows
  • Keying vehicles
  • Etching in desks, tables or other furniture
  • Spray painting or graffiti
  • Destruction of a church or synagogue
  • Destruction of government facilities or public property (including highways)
  • Destruction of crops or farmland

Tampering with property can cause irrevocable damage to the owner. If you have a vandalism charge and get convicted you may be required to pay for damages to the property owner along with court fines and penalties.

False Vandalism Charges May Still Lead to Conviction

If you don?t have right representation, and know you weren?t involved in a vandalism crime, you still could be convicted of a criminal misdemeanor. The best course of defense is to hire an experienced attorney who is well-versed in criminal law. Ryan Russman has years of experience as a NH criminal attorney and has helped hundreds of clients prove their innocence. Why suffer the consequences if you didn?t commit the crime?

Vandalism Laws in New Hampshire

According to the vandalism laws of New Hampshire, destroying property is considered criminal mischief. Anyone who has damaged another?s property by defacing, rendering useless, or otherwise destroying could be subject to vandalism laws. New Hampshire stipulates that this type of criminal mischief is considered a Class B felony, or Class A misdemeanor depending on the circumstances that surround the crime. The following types of crimes may be subject to a felony conviction:

  • Financial losses in excess of $1000
  • Impairing public communication, transportation or other services (such as water or gas)
  • Damaging historical or cultural private or public property
  • Discharging a firearm in public indoor area

When a property owner reports less than $1000 but more than $100 in damages, the vandalism charge could be changed to a misdemeanor.

Space launch: One small step for China, one giant opportunity for investors

As China prepares to launch its first manned space flight in four years, Chinese stock prices are going up.?

For some canny Chinese stock pickers, however, it is a chance to make money.

The Shenzhou 9 mission, due to take off on Saturday, will send three ?taikonauts,? one of them a woman, to dock for the first time with China?s orbiting space lab. The maneuver will mark a major step toward Beijing?s goal of building its own space station.

Back on Earth, meanwhile, the flurry of publicity surrounding the launch has done wonders for the stock prices of Chinese state-owned firms in the space sector. One of them has seen the value of its shares jump 16 percent since the mission was announced Saturday.

The Chinese government and the companies it controls are generally tight-lipped about the space program, releasing information to the public only at high points such as rocket launches. ?Shares go up because they are stimulated by the news,? says Li Qin, an aerospace analyst at China Investment Securities in Beijing.

At the same time, adds Mr. Li, launches are evidence of progress in China?s space sector, ?which sparks market expectations of the sector, so speculative investors jump in.?

The last time China launched a rocket in its space lab program, last year, space sector stocks bucked a falling market to rise by about 10 percent, Li recalls. They have risen by the same amount over the past four days, he says, led by Shaanxi Aerospace Power, a manufacturer of rocket parts, whose shares have leaped 16 percent.

Last year, though, as soon as the Shenzhou 8 rocket had docked with the space lab and interest in its journey faded, the stock prices fell back to their previous levels, Li says, and he expects the same thing to happen this time.

?You could make money if you?d bought space sector stocks on Monday,? he says. ?But you?d have to be careful to sell them before the rocket is launched.?

Strategic Planning:
Focus More on the Forest ? and Less on the Trees

?

?Sometimes, it?s hard to see the forest for the trees.?

Certainly, you?ve heard this saying before ? in fact, you?ve probably said it yourself more than once. It?s a perfect description of the dilemma many closely held business owners often face:

As the owner, you?re the one who?s ultimately responsible for the success or failure of your business. Therefore, you may feel like you have to manage and oversee all the minutiae and details involved in running the business.

But is this really your job? Most experts would say no. Instead, the most important job of a business owner is to set the strategic course and direction for the company and cast an over-arching vision that inspires everyone else. Or in other words, to take your focus off of the ?trees? and shift it to the ?forest.?

Strategic and Business PlanningDownload Weinstein & Anastasio, P.C.s FORESIGHT Newsletter
In business-speak, focusing on the forest instead of the trees is known as strategic planning. Note that strategic planning is different from business planning.

Strategic planning is big-picture planning: It is the process of defining your company?s strategy and making decisions about how you will allocate resources to pursue this strategy. Strategic planning focuses on things like goals, mission, vision and values for the organization.

Business planning is more tactical, focusing on specific action items that need to be accomplished in order to make the strategic plan become a reality. As the name implies, a strategic plan should lay out a detailed strategy for how the business will implement the tactics outlined in the business plan to achieve the stated goals and vision.

Creating a strategic plan enables a business to be proactive in charting out a course for its future, instead of being reactive to forces that are outside of its control. It also helps ensure that the goals of the business and of individual employees are in alignment with each other, and that everyone is pulling in the same direction, instead of against one another.

With a strategic plan in place, you can more easily decide how to best employ your existing resources ? both human and capital ? toward the achievement of your long-term objectives. Also, a strategic plan makes it easier to identify which opportunities you should devote these resources to, and which ones might be best to stay away from.

How to Do It
At this point, you may be saying to your-self, ?I know strategic planning is important, but I just can?t seem to find the time to make it happen.? But if you wait until you and your management team have the time for a strategic planning session, it will probably never hap-pen. So make a commitment now to set aside the better part of one or two days for you and your key managers to get offsite, roll up your shirtsleeves and plan your business? strategy.

It might be a good idea to bring in a facilitator from outside your company to help structure and lead the strategic planning session. He or she should be someone who knows your industry well and can share best practices that have worked with similar businesses. Such an impartial outsider can likely bring a fresh, ?out-of-the-box? perspective to problems and issues that are hard for you and other insiders to see.

What should you focus on when planning strategically? Management consultant Verne Harnish, aka the ?Growth Guy? (http://www.gazelles.com), has identified four key areas that companies should zero in on in their strategic planning efforts:

1. People ? According to Harnish, this includes not just your employees, but your customers and suppliers as well. What does your ideal employee look like, and how can you attract more of these (and fewer less-than-ideal employees)? What types of customers are your most profitable, and what should your salespeople be doing to meet more of them (and fewer unprofitable customers)? And are your current suppliers aligned with your company?s strategy, vision and mission?

2. Execution ? This includes all the processes that are followed in the manufacture of products or the delivery of goods and/or services to your customers, as well as internal procedures that govern workflow throughout your organization. One possible sign of execution problems Harnish points to is increasing revenues that are not resulting in proportional increases in profits. Tightening up execution can increase your productivity, gross margins and profitability.

3. Growth and Cash ? Harnish?s first law of what he calls entrepreneurial gravity is that ?growth sucks cash.? Therefore, any strategic plan must consider the impact that growth will have on the company?s cash flow. He encourages companies to calculate and monitor their cash conversion cycle before embarking on aggressive growth plans. This measures how long it takes from the time a business spends a dollar (on raw materials, inventory, marketing, overhead, etc.) until it gets that dollar back in the form of collected accounts receivable.

4. Strategy ? This encapsulates everything else. Harnish believes one of the most obvious signs that a company?s overall strategy needs to be re-examined is whether top-line revenue is growing or not. If it?s not, or if revenue isn?t growing as fast as you?d like, take a fresh look at what products you?re selling to which customers, for how much, and how you?re marketing to these customers.

An Ongoing Process
Ideally, you should schedule a strategic planning meeting with all your key man-agers and other employees once a year. But this doesn?t mean the strategic planning process should be confined to just an annual meeting. Daily execution of the action steps identified and outlined in your strategic plan is what will determine whether the plan is successful or not.

Also, don?t be afraid to tweak your strategic plan as circumstances change. You don?t have to wait for the next annual planning meeting to make necessary adjustments. By then, you could have missed out on timely opportunities ? or worse, been victimized by unforeseen events that adversely impacted your business.

We can help your business with the process of strategic planning. To learn more, give us a call today.

Vision vs. Mission: What?s the Difference?

The terms ?vision? and ?mission? are sometimes used interchangeably, but they?re really two different things:

? Vision provides a blueprint for what the organization wants to be and what it should stand for. It is long term in nature, answering the question, ?Where do we see the business three, five or 10 years in the future?? A vision should inspire and motivate everyone in the organization.

? A mission (or mission statement) defines the fundamental purpose of the organization. It should succinctly answer the question, ?Why does our company exist?? In crafting a mission statement, dig deep in identifying a reason for existence beyond just creating a product or making money. Strive to create a mission statement that?s easy to understand and remember, instead of writing some long-winded ?corporate-speak? phrase that doesn?t really mean anything.

Any business that manufactures goods or products of any kind knows how vulnerable it can be to wild fluctuations in the prices of raw materials. And when you look at a chart of commodity prices over the past few years (at right), it resembles
a roller-coaster ride at your favorite summer amusement park.

After a decade of relative stability going back to the early 1990s, the Commodity Price Index (CPI) began a gradual climb in 2002 (from 49) that accelerated sharply in mid-2007 and peaked a year later at 220. Commodity prices then plunged in early 2009, with the CPI falling to 100 in March, only to begin another steady climb until peaking again in April 2011 with a CPI of 213.

Commodity prices then fell again through the end of last year before starting to rise in early 2012, when the CPI rose to 196 in February. The price indexes for food, agricultural raw materials, metals and fuel have all tracked the CPI fairly closely.

No Signs of Stability
Volatility in raw material costs has been attributed to everything from soaring fuel and energy costs to a weak dollar and rising worldwide commodity demand, especially from China and other emerging market countries experiencing rapid growth. Unfortunately, there don?t appear to be signs of stability in any of these areas anytime soon.

Unpredictable raw material costs can wreak havoc on a manufacturer?s gross profit. Of course, falling commodity prices can increase profits, but these profits can vanish just as quickly when prices shoot back up again.

To help shield themselves, manufacturing companies should develop strategies for dealing with this volatility in raw material prices. Here are a few ideas to consider:

Shop aggressively for raw materials. If you?ve always relied on the same one or two vendors to supply raw materials, broaden your scope to look for other suppliers that might offer better prices. Let your existing suppliers know that you are soliciting bids from their competitors and give them the first crack at retaining your business ? but also make it clear that, all else being equal, the lowest price will win.

Also consider committing to minimum quantity purchases, if this is feasible. If you know that you will be buying a certain amount of a particular raw material over the next six months or year, for example, you might be able to negotiate a lower price by telling your vendor they can expect this volume from you.

Decrease your fixed and variable costs. While you might have limited control over raw material costs, there are many fixed and variable costs you probably can control. Have you taken a close look at your overhead lately? What about inventory ? are you using just-in-time (JIT) inventory management techniques to minimize inventory holding times? And are you managing your supply chain for maximum efficiency?

Change your product design. Pro-ducts are not always designed with manufacturing efficiency in mind. Sometimes, relatively minor tweaks in product design ? a slight change in shape or size, for example ? can result in increased efficiency that boosts the bottom line.

Institute commodity surcharges. Price increases of any kind always have to be handled carefully. But in today?s environment, many customers are understanding of increases that are properly positioned and explained to them.

Positioning price increases as ?commodity surcharges? that are proportional to your increased raw material costs helps customers understand the reason for the increase. Commodity prices are published by many trade associations, so your customers can probably verify the increases if they want to.

It Works Both Ways
Keep in mind, however, that customers will expect these surcharges to be reduced or eliminated if and when commodity prices decline. When gasoline first topped $4 a gallon in the summer of 2008, many businesses that are heavily fuel-dependent (like landscapers and delivery services) added fuel surcharges to their bills. But when prices fell back down near $2 a gallon, some didn?t remove the surcharge ? and many of their customers noticed.

So approach the issue of commodity surcharges carefully. It might be simpler to just institute a straight-line price increase if the market will bear it.

What Is XBRL ? and How Could You Benefit?

There?s something new and exciting going on in the world of financial data and reporting: XBRL, a technology language for the electronic communication and exchange of financial data between businesses.

XBRL allows unique tags to be placed on items of data in a business or financial report. The tags include such information as item descriptions, units or currency that make it easier for users of the information to identify and understand it. Companies can customize these tags to create elements (or extensions) that describe their own unique reporting situations. XBRL-tagged data is computer-readable, which makes it easier for businesses to extract, search and analyze the information.

Note that XBRL is not a new accounting standard and will not change what data is reported; rather, it simply changes how the data is reported. In 2009, the Securities and Exchange Commission adopted final rules requiring public (but not private) companies to submit their financial statements in XBRL format. The requirement is being phased in over four years. XBRL may offer:

? Greater automation ? Resources can be shifted away from costly and time-consuming manual processes that involve comparison, assembly and re-entry of data and toward more useful data analysis. For example, most data searches can be completed almost instantaneously using XBRL

? Better data creation ? Financial or business information tagged in XBRL format can be used to create many other documents in different formats, such as HTML, ASCII text, or a Microsoft Excel spreadsheet or Word document.

? Better business information reporting ? This includes the entire reporting chain of business information, from data collection through internal and external reporting for more accuracy and efficiency.

? Uniformity of data ? XBRL includes a common set of definitions by which all organizations tag their data, making it easy for information to be compared from one organization to another.
