America's deadliest soldier? Dillard Johnson says he never made that claim.

Retired Army Sgt. Dillard Johnson's new Iraq war memoir has angered other veterans. He says the criticism is mostly unfair.

Yesterday I wrote about Dillard Johnson's new book "Carnivore," published by the News Corporation's HarperCollins and heavily promoted by News Corporation outlets like the New York Post and Fox News.

The promotional effort around the book has carried a hard-to-believe, almost impossible claim: that Johnson had 2,746 "confirmed" enemy kills over the course of two tours in Iraq. His first tour came during the 2003 invasion and the second for roughly 12 months starting in February 2005. The claimed kills, which first surfaced in NewsCorp's New York Post on Monday ("With 2,746 confirmed kills, Sgt. 1st Class Dillard Johnson is the deadliest American soldier on record ??and maybe the most humble"), was then repeated on a number of Fox News programs this week and mirrored around the Internet.

Similar claims are made in HarperCollins' publicity for the book ("He is recognized by the Pentagon to have accounted for more than 2,000 enemy killed in action," says the book jacket; "Credited with more than 2,600 enemy KIA, he is perhaps the most lethal ground soldier in U.S. history," says both the book jacket and a blurb the publisher supplied to Amazon; the book cover calls him "One of the deadliest American soldiers of all time.")

Mr. Johnson says there's one problem: It isn't true.

He says the book doesn't contain that claim, that he never claimed to have killed 2,746 enemy fighters in Iraq, and that he didn't kill that many people in Iraq. He says a combination of innocent mistakes by others and a desire by HarperCollins and his co-author to promote the book have led to the impression he's making claims that he hasn't made. He says a personal and informal total of likely enemy fighters killed during engagements in the Iraq invasion has been attributed to him, when in fact the total includes shooting from the Bradley he commanded as well as shots fired from Bradleys around him and commanded by others ??his wingmen.

"Am I one of the deadliest American soldiers of all time? Probably not," says Johnson. "Do I think I did a lot of damage with my vehicle and stuff, with me being decisive? Yeah, absolutely."

These and other claims have drawn angry denunciations from a large number of soldiers who served with him in Iraq, who say he played an important role in their effort but did not come close to what's been written about him in the press.

Johnson says he agrees, and says the attribution of so many dead to him personally traces back to a 2004 Pentagon history of the invasion, On Point: The United States Army in Operation Iraqi Freedom. He was interviewed for the book and says it's been wildly misinterpreted, especially since the chapter he features in was excerpted by Soldier of Fortune magazine, with editorial changes made by someone there that exaggerated his personal role in the fighting.

His assertion of 121 "confirmed" sniper kills made in his book has also drawn howls of derision. Johnson is not trained as a sniper and was not equipped with a sniper rifle. He says his personal tally of 121 enemy killed during his second tour is correct, but that "I didn?t use a sniper rifle, I am not a sniper. Nowhere in the book does it say that I?m a sniper. It?s in the jacket, again, but I didn?t write that." He told me that all these kills were with M4 and M14 rifles.

He told Fox New's Laura Ingraham on the O'Reilly Factor ? the evening after an appearance on Fox & Friends that morning that infuriated many veterans, and prompted angry emails from some former comrades ? that the 121 kills involved "the M14 and my M4 personal rifle and some 203 ones." A 203 is a single shot grenade launcher and attributing specific deaths to a grenade launched over distance is both difficult and definitely not a form of "sniping."

Johnson explains that the choice of "sniper" in the book was for ease of understanding for the general civilian public. "When you look inside the cover and see the talk about the 121 confirmed sniper kills [that's because] most civilians don?t know what a designated marksman is," he says. He said his platoon didn't have many trained marskmen and that since he was a naturally good shot, he took on those kinds of duties to protect himself and his men.

Some of Johnson's stories have shifted over time.

He told Ms. Ingraham this week that the long shot, which he says in that interview was 821 yards, "was sort of a sniper battle from a rooftop and I got this guy. It took me 15 shots. He was a better shot than me. I just had better equipment and he was missing all around me and I basically just got lucky." But here's what Stars and Stripes reported him as saying about the incident on Dec. 20, 2005:

?I used my laser rangefinder to give me the distance to the enemy location, it was 852 meters exactly, a long shot,? Johnson said then, according to a 2nd Brigade Combat Team press release carried by the newspaper. He reported there were two insurgents there and that they were firing towards his rooftop position. ?I engaged one enemy shooter with my own rifle. My first round fell short but it must have scared him because he stood up to run away. The next round I fired, hit him and he went down,? Johnson said.

On his O'Reilly appearance, Johnson corrected his host when she attributed 2,746 kills in Iraq to him personally. He says he wished he'd done that in the earlier Fox & Friends interview but that he was only on for about three minutes, and as it was his first television appearance, he was a little flustered.

"I was trying to get that in on Fox & Friends, but didn?t have time. Did on O?Reilly with Laura Ingraham," he tells me. He told Ingraham:?

"As far as the kills go ... I?m not really proud of those numbers being out there, it was part of the battle damage assessment that we did. My gunner actually did, you know, most of those or over half of those in the vehicle there and I was just present on the vehicle ... which I was the commander of."

Soldiers in general don't like to keep body counts, and while they may be proud of killing enemies in engagements, keeping their buddies safe, and accomplishing their missions, bragging about kill numbers is generally seen as uncouth, if not a downright creepy. Johnson agrees with that, and says there's no intent to brag about killing. Rather, he says, he kept track of enemy dead by counting rifles on the battlefield after engagements (on the reasoning that "one rifle equals one man") as a way to keep senior officers as informed as possible about the course of the war.

Johnson was kind enough to speak to me for about two hours last night. I'm currently sifting through my long notes of my conversation with him, and will revisit the story after I read his book myself this evening.

What could surprise Jeffco sewer ratepayers on bankruptcy deal ...

BIRMINGHAM, Alabama -- Jefferson County sewer rates could increase more than previously announced amid higher interest rates and unfunded capital expenses toward the end of the deal, according to documents and interviews.

The county has a Sunday deadline to file with a federal judge planned support? agreements with creditors that would allow the county to exit bankruptcy by the end of the year.

Commissioner Joe Knight said today the sewer rates could still be "tinkered or adjusted" depending on what's discussed during a Thursday meeting with bankruptcy lawyers.?

Commissioner George Bowman told the county's committee of the whole during today's meeting that he continues to oppose the agreement with creditors because of the impact sewer rates would have on residents.

"Embedded in the plan is a provision that if the revenue that comes in is not sufficient to meet the projections to pay the debt than the rates can be increased even higher . . . so the ratepayers on the sewer will absorb that (additional) debt," Bowman said.

The county announced a bankruptcy settlement deal with creditors this month that includes rate increases of 7.41 percent for four years and 3.49 percent per year afterwards for the foreseeable future.

County officials said that deal was better than one discussed that would have meant a one-time 30 percent increase in sewer rates.

But, some finance experts say the county's proposed single digit sewer increases could grow amid rising interest rates and a steep drop in the $3.7 trillion municipal bond market that has lifted yields on some bonds to levels not seen in the past two years.

"Any movement in a heretofore stabilized market is a cause for concern," Commissioner Jimmie Stephens said. "It is troublesome."

The county's plan to emerge from bankruptcy this fall hinges in part on the sale of $1.9 billion in refinanced debt.

County officials have said the deals with creditors contain a half percent cushion for an increase interest rates. However, that may not be enough to avert problems, say some finance experts.

"You don't leverage yourself to best possible forecast, "said Robert Brooks, professor of financial management at the University of Alabama. "That's a path to financial distress."

Richard Ciccarone, of McDonnell Investment Management, whose firm purchases municipal bonds and oversees an $8 billion portfolio of them, said it's too early to tell whether the county's plan will work, but "the trends are working against them," he said.

To the extent that borrowing costs increase you can expect the sewer rates to increase, he said. "It's a mirroring effect," he said. "More than likely the borrowing rates will have an impact on their projections for user charges."

And proposed settlement documents show that capital expenditures (Capex) are not fully funded after 2031 which could cause higher sewer rates for future generations.

For example, the Capex shortfall in the county's settlement plan in 2032 is $40 million. That amount grows, based on inflation, through 2052 when the figure is $74 million, according to the document.

That shortfall could be made up with higher sewer rates or issuing new debt to pay for the capital needs at the time.

Two other points: the county's original Capex plan fully funds capital needs for the system throughout the entire deal while the proposed settlement funds Capex over the next 20 years and projects shortfalls in years 2032-2053.

And, the original plan also has a "net pledge" which means the operations of the system gets paid no matter what while the proposed deal has a "gross pledge" which means debt service - or creditors - get paid first.

Observers say a gross pledge is the only way the markets would accept a debt refinancing from Jefferson County, given its unstable financial history.

County officials reiterated today that they were comfortable with the terms of the deal which includes creditor write-downs of approximately $1.247 billion of the existing sewer debt and contains financing that decreases the total amount of debt? principal and interest payable over the 40-year term.

Afghan peace bid stumbles on Kabul-Taliban protocol row

DOHA (Reuters) - A fresh effort to end Afghanistan's 12-year-old war looked in trouble on Thursday after a diplomatic spat about the Taliban's new Qatar office delayed preliminary discussions between the United States and the Islamist insurgents.

A meeting between U.S. officials and representatives of the Taliban had been set for Thursday in Qatar but Afghan government anger at the fanfare surrounding the opening of a Taliban office in the Gulf state threw preparations into confusion.

The squabble may set the tone for what could be arduous negotiations to end a conflict that has torn at Afghanistan's stability since the U.S. invasion following the September 11, 2001 al Qaeda attacks on U.S. targets.

Asked when the talks would now take place, the source in Doha said "There is nothing scheduled that I am aware of", and confirmed that meant they would not happen on Thursday.

The opening of the office was a practical step paving the way for peace talks. But the official-looking protocol surrounding the event raised angry protests in Kabul that the office would develop into a Taliban government-in-exile: A diplomatic scramble ensued to allay their concerns.

U.S. Secretary of State John Kerry spoke with Karzai on Tuesday night and again on Wednesday morning in an effort to defuse the controversy, U.S. and Afghan officials said.

A Taliban flag that had been hoisted at the Taliban office on Tuesday had been taken down and lay on the ground on Thursday, although it appeared still attached to a flagpole.

A name plate, inscribed "Political Office of the Islamic Emirate of Afghanistan" had been removed from the outside of the building. But a similar plaque fixed onto a wall inside the building was still there on Thursday morning, witnesses said.

Asked whether the Taliban office had created any optimism about peace efforts, the source replied: "Optimism and pessimism are irrelevant. The most important thing is that we now know the Taliban are ready to talk, and sometimes talk is expensive."

Word of the U.S.-Taliban talks had raised hopes that Karzai's government and the Taliban might enter their first-ever direct negotiations on Afghanistan's future, with Washington acting as a broker and Pakistan as a major outside player.

The Taliban has until now refused talks with Kabul, calling Karzai and his government puppets of the West. But a senior Afghan official said earlier the Taliban was now willing to consider talks with the government.

PRISONER SWAP

Pakistan's powerful military played a central role in convincing the Taliban to hold talks with Washington, U.S. and Pakistani officials said, a shift from widely held U.S. views that it was obstructing peace in the region.

A prisoner swap is seen as likely to happen as the first confidence-building measure between the two sides, said one Pakistani official, who declined to be named.

But he said there were many likely spoilers in the peace process who would want to maintain the status quo to continue to benefit from the war economy and the present chaotic conditions.

"The opening of a Taliban office and the American readiness to hold talks with the Taliban is a forward movement. What happens next depends on the quality of dialogue and political will of the interlocutors," he said.

Pakistan has been particularly critical of Afghan President Hamid Karzai, seeing him as an obstacle to a peace settlement.

In its talks with the U.S. officials, the Taliban was expected to seek the return of former commanders now held at the Guantanamo Bay prison, a move opposed by many in the U.S. Congress, as well as the departure of all foreign troops.

The United States wants the return of the only known U.S. prisoner of war from the conflict, Sergeant Bowe Bergdahl, who is believed to be held by the Taliban.

The protocol dispute burst into the open on Wednesday when Afghan President Hamid Karzai said his government would not join U.S. talks with the Taliban and would halt negotiations with Washington on a post-2014 troop pact.

Officials from Karzai's government, angered by the official-sounding name the Taliban chose for its political office in Doha, said the United States had violated assurances it would not give official status to the insurgents.

"As long as the peace process is not Afghan-led, the High Peace Council will not participate in the talks in Qatar," Karzai said in a statement, referring to a body he set up in 2010 to seek a negotiated peace with the Taliban.

A statement on Qatar's foreign ministry website late on Wednesday clarified that the office which opened was called the "Political Bureau for Afghan Taliban in Doha".

The source familiar with the matter said: "The Taliban have to understand that this office isn't an embassy and they are not representing a country."

The dispute over the Taliban office after months of behind-the-scenes diplomacy to restart the peace talks underscored the tensions between Karzai and the Taliban, who have been waging an insurgency to overthrow his government and oust foreign troops.

Fighting continued in the war-damaged nation. Four U.S. soldiers were killed in a rocket attack on the heavily fortified Bagram base near Kabul late on Tuesday.

Underlining the importance of the peace process to Washington, the State Department said Kerry would travel to Doha for meetings with senior Qatari officials on Friday and Saturday. But U.S. officials said he would not meet with Taliban representatives.

AP PHOTOS: Protesters in Brazil vow further action

Protests that began as an outcry against a 10-cent hike in bus and subway fares in Brazil's largest cities haven't ended with Wednesday's announcement that the increases would be rescinded. Protest organizers have called for mass demonstrations on Thursday in Sao Paulo and Rio de Janeiro, as people express frustration with corruption and what they say are high taxes and poor public services. Brazil will host the 2014 World Cup, but protesters say that the billions now spent on soccer stadiums would be better used for education, health and public safety.

President Dilma Rousseff has praised protesters for strengthening democracy in Brazil, where mass protests are rare. But police have responded to them with tear gas, pepper spray and rubber bullets.

The deal, which was authorized in a 6-0 vote by the district?s school board, will find Apple providing nearly 35,000 iPads to 47 LAUSD schools for around $678 per device. Tropical Storm Barry bears down on Mexico's coast

VERACRUZ, Mexico (AP) ? Tropical Storm Barry bore down on Mexico's Gulf Coast early Thursday as civil defense workers readied emergency shelters and forecasters warned of the possibility of deadly flash floods and mudslides.

The second tropical storm of the Atlantic hurricane season packed 45-mph (75-kph) winds that were already being felt as the storm edged toward an expected morning landfall northwest of the port city of Veracruz, authorities said.

The U.S. National Hurricane Center in Miami said the storm was about 30 miles (45 kilometers) north of the Gulf Coast port at 5 a.m. EDT and heading west at 5 mph (7 kph).

The Miami forecasters said Barry would move inland with drenching rains in coming hours and eventually dissipate on Friday over southern Mexico while crossing land.

Between 3 and 10 inches of rain were possible and warned the rains could trigger life-threatening flash floods and mudslides, especially over mountainous areas, forecasters said. Tropical storm force winds were spreading outward up to 80 miles (130 kilometers) from the center of the system.

Early Thursday, blustery winds were already being reported around the Gulf Coast areas closest to the storm's center. Forecasters said tropical storm conditions were already lashing the coast early Thursday and the high winds would continue through Thursday morning.

A tropical storm warning was in effect from Punta El Lagarto to Tuxpan, in Veracruz state.

Veracruz state Civil Protection Secretary Noemi Guzman said 2,000 shelters had been readied in the state with mattresses, blankets, water and canned food. She said the shelters at schools and recreation centers could house up to 306,000 people.

The port of Veracruz was closed to small vessels because of the strong winds, Guzman added.

The storm had formed as a depression off the coast of Belize on Monday and began moving northward, dumping heavy rains on parts of that country and northern Guatemala before entering Mexico's Bay of Campeche earlier in the week.

Why Congress Must Investigate NSA's Unconstitutional Spying

In the past couple of weeks, the NSA has, unsurprisingly, responded with a series of secret briefings to Congress that have left the public in the dark and vulnerable to misstatements and word games. Congress has many options at its disposal, but for true accountability any response must start with a special investigative committee. A coalition of over 100 civil liberties groups agrees. Such a committee is the right way the American people can make informed decisions about the level of transparency and the reform needed.

A Special Investigatory Committee is the Right Way to Shine the Light and Create True Accountability

A special investigatory committee should be bipartisan, consist of selected Intelligence and Judiciary committee members on both sides of the issue, and have full subpoena powers. After Watergate, Congress created the Church Committee to investigate domestic spying and other illegal actions committed by the intelligence community. What it found was staggering: in one example of abuse, the NSA was reading and copying all telegrams entering and exiting the country. In another, NSA had intercepted, opened and photographed more than 215,000 pieces of mail?mass surveillance circa 1970. The Church Committee brought these revelations to light, informed the American people, and took steps to limit the broad nature of the surveillance.

The contemporary Congress must create a similar, independent, and empowered committee. The President and some members of Congress prefer an investigation by the President?s appointed Privacy and Civil Liberties Oversight Board (PCLOB), but the Board is not even empowered to issue subpoenas. And the two key committees that rubber-stamped the expansion of the NSA spying from foreigners-only to ordinary Americans have proven themselves unable to rein in the spying.

President Obama says he welcomes a public debate on the programs. If he?s serious, he and Congress need to take the path of a modern day Church Committee.

The PCLOB

Last week, Senators called for an investigation by the PCLOB. The PCLOB was one of the recommendations of the 9/11 Commission and was set up to try to ensure that privacy and civil liberties played a role in the enormous expansion of surveillance laws like the PATRIOT Actand Foreign Intelligence Surveillance Amendments Act. Yet it has not. Instead, the PCLOB has lingered without a chairman?making it inoperable?for almost five years. It was only until this spring that the Senate finally confirmed David Medine as the chair, however the PCLOB has done little, if anything, since then. That?s because it has no real power. If the PCLOB asked the NSA for certain documents related to the spying, for instance, the NSA would not have to hand the documents over or present testimony under oath. In a hearing this week, General Alexander, the Director of the National Security Agency, committed to cooperating with any investigation by the PCLOB. But given the NSA?s history of gross misdirection, word games and limited answers to direct questions?including General Alexander?s own falsehoods in Congressional testimony?this investigation should not rely on the good will of the NSA. Yet, that?s exactly what the PCLOB would have to rely upon.

Hearings in Front of the Judiciary or Intelligence Committees

Nor do the Judiciary or Intelligence committees hold great promise. These committees should serve as the American people?s robust window into?and constitutional check on?intelligence operations. For instance, in 2005, when the New York Times first reported on the warrantless wiretapping, many hearings took place in front of both the Senate and House Judiciary and Intelligence committees. The Committees certainly did not reveal the full extent of the spying, even though they had the opportunity. Instead, politicians were stonewalled, swallowed grossly misleading answers, and revealed few details.

Currently, the Senate Intelligence committee has met publicly only 2 times this year; from 2011 to 2012 it only met 8 times. The House of Representatives is no different. The House Intelligence committee's Subcommittee on Oversight has not met once this year. Yes, not once. And the full House Intelligence committee has only met four times. History tells us a similar story about the Judiciary Committees.

The public demands for a robust debate require more transparency and tenacity than these committees seem able to provide.

The Secret Veil Must Be Lifted

In short, the lessons of 2005 is that the standing Congressional committees are unable to get at the bottom of the NSA spying and the PCLOB does not have sufficient power to do so either. A special investigative committee with full subpoena powers, the ability to force testimony under oath, and the ability to issue sanctions for failure to cooperate is the best hope that the American people have to ensure the NSA's domestic spying isn't swept under the NSA?s giant secrecy cloak once again. Tell Congress now to act.
